1. Agreement to Terms

These Terms & Conditions ("Terms") govern your use of the Higher Realms Digital website and the purchase of services offered by Higher Realms Digital, owned and operated by Ericka Allen ("we," "us," or "our").

By accessing our website, booking a call, or purchasing any service, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

2. Services

Higher Realms Digital provides technology services for women in business, including:

• Get Unstuck Session — a focused 60-minute working session to troubleshoot a specific tech or systems problem ($149)

• Setup Service — full HighLevel account configuration and systems setup ($297)

• Discovery Call — a free introductory call to explore whether our services are a fit

• Custom software and mobile app development (React Native, TypeScript)

• HighLevel and FEA Create platform services, including admin, customization, and template buildout

• The Aligned Morning Briefing — an AI-powered daily morning briefing delivered by email, personalized via your Voice DNA intake form and connected to your Google Calendar and Gmail with your explicit consent. Currently offered on a subscription basis to founding members at $19 per month, billed monthly. See Section 4 for refund and cancellation terms specific to this service.
  

Service descriptions, deliverables, and timelines for custom engagements will be confirmed in a separate written agreement or proposal prior to work beginning.

3. Payment Terms

Payment is due at the time of booking or prior to the commencement of services, unless otherwise agreed in writing. All prices are listed in U.S. dollars.

We accept payment via Stripe. By providing payment information, you authorize us to charge the applicable fees.

For custom or ongoing engagements, payment schedules will be outlined in the applicable project agreement. We reserve the right to pause or discontinue work if invoices remain unpaid past their due date.

Subscription Services

The Aligned Morning Briefing is billed as a recurring monthly subscription. By subscribing, you authorize us (via Stripe) to charge your designated payment method on the same calendar day each month until you cancel.

Failed payments are automatically retried by Stripe up to three times. If all retries fail, your subscription is paused and your daily briefings stop until payment is restored. We will email you when a payment fails so you can update your payment information.

Founding members lock in $19 per month for as long as their subscription remains continuously active. If a founding-member subscription is cancelled (including by chargeback or sustained payment failure), the founding rate is forfeited; resubscription is welcome but at the then-current standard rate.

4. Refund & Cancellation Policy

Discovery Calls

No payment required. You may cancel or reschedule at any time using the booking link provided.

Get Unstuck Session

Full refund if cancelled at least 24 hours before the scheduled session. Cancellations within 24 hours or no-shows are non-refundable. You may reschedule once with at least 12 hours' notice.

Setup Service

Full refund if cancelled before work has begun. Once work has started, refunds will be prorated based on the portion of work not yet completed, at our discretion. No refunds are issued after delivery of the completed setup.

Custom Engagements

Custom development and contract engineering engagements operate on a 50% / 50% payment structure: 50% of the project total is due before work begins, and the remaining 50% is due upon project completion and delivery. The initial payment is non-refundable once work has commenced.

If a custom engagement is cancelled after work has begun, you will be invoiced for the portion of work completed at the time of cancellation, up to the remaining balance. Specific terms may be outlined in the applicable project agreement and will govern where they differ from the above.

Chargebacks

If you initiate a chargeback or payment dispute without first contacting us to resolve the issue, we reserve the right to dispute the chargeback and provide evidence of services rendered. We are always willing to work in good faith to address concerns before escalation.

The Aligned Morning Briefing

First-month refund. If you are not happy with your first month of briefings for any reason, email us within 14 days of your initial purchase and we will refund your first month in full, no questions asked.

Cancel anytime after. You may cancel your subscription at any time by emailing us or via your account portal. Cancellation takes effect at the end of your current billing period; you retain access through the end of that period. We do not prorate or refund partial months after the initial 14-day refund window.

Founding rate. As noted in Section 3, the founding-member rate of $19 per month is preserved only while your subscription is continuously active. If you cancel and later resubscribe, you will be billed at the then-current standard rate.

5. Client Responsibilities

To enable us to deliver services effectively, you agree to:

• Provide accurate, complete information as requested

• Respond to communications in a timely manner

• Provide necessary access to platforms, accounts, or assets needed for service delivery

• Review and provide feedback on deliverables within the timeframe specified

Delays caused by your failure to meet these responsibilities may affect project timelines and are not grounds for a refund.

6. Acceptable Use

By using The Aligned Morning Briefing or any other service provided by Higher Realms Digital, you agree NOT to:

• Attempt to access another buyer's account, data, briefings, or personal information

• Reverse-engineer, decompile, scrape, or attempt to circumvent the technical protections of the service, including its authentication, encryption, or rate-limiting mechanisms

• Use the service in violation of any applicable law, regulation, or third-party rights

• Connect a Google account that you do not own or do not have explicit authorization to connect

• Share your login credentials, account access, or personalized briefings with others in a way that allows them to use the service without their own subscription

• Use the service or its output to harass, defame, deceive, or harm any individual or group

• Attempt to use the service for automated, bulk, or commercial purposes outside its intended single-user, personal-productivity scope without our prior written consent

We reserve the right to suspend or terminate any account that violates these Acceptable Use terms, with or without prior notice depending on the severity of the violation. Cancellations for cause do not entitle the account holder to a refund of any unused subscription period.

6. Intellectual Property

Our Content

All content on the Higher Realms Digital website — including text, graphics, logos, guides, and course materials — is the intellectual property of Higher Realms Digital and is protected by applicable copyright and trademark law. You may not reproduce, distribute, or create derivative works without our prior written consent.

Work Product

Upon receipt of full payment, you own the final deliverables created specifically for you under a custom engagement, unless otherwise specified in your project agreement. We retain the right to use general methodologies, frameworks, and non-client-specific tools developed during our work together.

Third-Party Platforms

Services delivered within third-party platforms (such as HighLevel) are subject to the terms of service of those platforms. Higher Realms Digital is not responsible for changes to third-party platform features, pricing, or availability.

7. Confidentiality

We treat all client information with discretion. We will not share your business details, strategies, or proprietary information with third parties without your consent, except as required to deliver our services (e.g., with platform providers) or by law.

We ask that you treat any proprietary processes, templates, or systems we share with you in the same way.

8. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be error-free, uninterrupted, or that results will meet any specific expectation.

Results from our services — including HighLevel setup, lead generation systems, or development work — depend on many factors outside our control, including your business, your audience, and your follow-through. We do not guarantee any specific business outcome.

AI-Generated Briefing Content

The Aligned Morning Briefing is generated by artificial intelligence (specifically, Anthropic's Claude model). While we work hard to ensure briefings are accurate, gentle, and aligned with your Voice DNA, AI-generated content may occasionally contain errors, mischaracterize calendar events, misread email importance, or include other inaccuracies.

Briefings are intended for supportive daily planning only. They are not professional advice — business, financial, medical, psychological, or otherwise. If you track your menstrual cycle within the service, the energetic suggestions in your briefing are informational only and are not medical advice or a substitute for guidance from a qualified healthcare professional.

Weather forecasts displayed in your briefing are sourced from third-party data providers and are estimates. Calendar and inbox information is read from your connected Google account and is only as accurate as the data in your Google account at the time of fetch.

We make no guarantee of specific business or personal outcomes from using the service.

9. Service Availability

The Aligned Morning Briefing is delivered on a best-effort basis. We strive to deliver every briefing at your chosen time each day, but cannot guarantee uninterrupted delivery. Briefings may be delayed or missed due to:

• Outages or rate limits at third-party services we depend on (Anthropic, Google, WeatherAPI.com, HighLevel, Cloudflare, Stripe)

• Maintenance or upgrades to our service

• Issues with your Google account or revoked OAuth access

• Email deliverability issues at your inbox provider

If a single briefing is missed, we will not issue a refund or credit. If briefings are systematically delayed or undelivered for more than 7 consecutive days due to issues on our end, contact us and we will work with you in good faith to make it right.

The service is currently offered as a founding beta. Some features may change, be added, or be removed over time. Founding members will be notified of material changes in advance and retain the locked-in $19 rate across any feature evolution.

10. Limitation of Liability

To the fullest extent permitted by law, Higher Realms Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services or website.

Our total liability for any claim arising from a specific engagement shall not exceed the total amount you paid for the services giving rise to the claim. For recurring subscription services, this means the total amount paid in the twelve (12) months immediately preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Higher Realms Digital, its owner, employees, and contractors from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of our services, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Indiana, without regard to its conflict of law provisions.

In the event of a dispute, we encourage you to contact us first at [email protected] so we can work toward a resolution in good faith. If a dispute cannot be resolved informally, it shall be subject to binding arbitration or the exclusive jurisdiction of the courts located in Clark County, Indiana.

13. Changes to These Terms

We reserve the right to update these Terms at any time. When we do, we will update the Effective Date at the top of this page. Continued use of our website or services after any changes constitutes your acceptance of the revised Terms.

For material changes, we will make reasonable efforts to notify active clients via email.
